Ltd. Site come under Materials. All materials from the site are proprietary and subject to copyright of Foxtraut Software Technologies Pvt. Ltd. and or its suppliers. However, ‘Materials’ does not encompass the design or layout of the Foxtraut Software Technologies Pvt. Software
A computer program of any kind encompasses in the term software. This includes computer programs whether owned by Foxtraut Software Technologies Pvt. Ltd. or a third party, whether delivered via download, CD, other media, or other delivery method, including client, node and/or computer management and network protection software. Software’s include both Foxtraut Software Technologies Pvt. Ltd. Software and third party Software. All elements of the Software are protected under copyright, trade secret, unfair competition, and other laws within the state/country of jurisdiction applicable to all its users. Your utilization of Software is subject to the respective agreements such as a license agreement or user agreement that accompanies or is included with the Software, ordering documents, exhibits, and other terms and conditions that apply ("License Terms").
Submission of plan orders or ‘Service’ plans
Users may submit plan orders through the Foxtraut Software Technologies Pvt. Ltd. site to place service orders or choose to call Foxtraut Software Technologies Pvt. Ltd. personnel.We provide on call resolution SLA of with in 48Hrs to resolve the quries. Once Foxtraut Software Technologies Pvt. Ltd. accepts the plan order submitted by the user, then the user will receive an email from Foxtraut Software Technologies Pvt. Ltd. at the email address that provided to the Foxtraut Software Technologies Pvt. Ltd. as part of the registration process for availing the services. Foxtraut Software Technologies Pvt. Ltd. has no responsibility for rendering services in connection with any plan order that it has not accepted explicitly. Once acceptance is granted by the Foxtraut Software Technologies Pvt. Ltd. of a plan order, the user will have the service plan for utilization.
Payment
Services against any plan order will be available for use to the user once the payment for services according to the requirements of the consequent plan order have been made in full. The user accepts and understands that certain service plans may have fee including, but not confined to "service fee" and/or "activation fee" billed either on spot on incident basis or in annual basis ("annual payment plan") or on a monthly basis ("recurring payment plan").
All payments under the annual plan shall be made upfront at time of initiation of the Plan cycle, subject to terms of the plan. As for payments under the recurring payment plan, aside from the monthly installments of the service fee, that is payable over a period of one (1) year payment term, users accept that they may be billed an additional non-refundable ‘activation fee’ at the time of registration, as specified in the plan order.
The fee (including activation fee) will not be refunded in case of cancellation of the service plan unless otherwise stated in the plan order. All fees under this clause or any related plan orders are payable at the time of commencement of the particular service plan in question.
When the user purchases any service, they explicitly agree to a specific price and plan, where such plan maybe for a term of one year, half a year, a quarter of a year or on a monthly basis ("term plan"). The terms of service fee and/or any other fee payable under any mode of payment for a Plan or service term shall be set during the induction of the applicable plan order.
Likewise, certain plans may add up with an offer of a discount on the service if the user chooses to sign up for other Foxtraut Software Technologies Pvt. Ltd. services ("bundle discount"). As the user you agree to maintain your service as well as the bundled services for the period of term, applicable.
If the user has signed up for a term, the price applicable with those plans will stay valid until one of the following occurs: The term plan expires or The user terminates the agreement/service plan before the specified expiry of the relevant term.
Credit card billing
Users may be asked to provide Foxtraut Software Technologies Pvt. Ltd. with a credit card number from a card issuer that the company accepts in order to activate the service ordered. You, the user hereby authorize Foxtraut Software Technologies Pvt. Ltd. to charge and/or withhold your credit card with respect to any unpaid charges for services or any related equipment that you may have procured from our company without furnishing proper payment.
Thus, you the user authorize the issuer of the credit card to pay any amounts described herein without requiring a signed receipt, and you agree that these charges are to be accepted as authorized billing to the issuer of the credit card to pay all such amounts.
Furthermore, you authorize Foxtraut Software Technologies Pvt. Ltd. and/or any other company who bills products or services, or acts as billing agent for Foxtraut Software Technologies Pvt. Ltd. to continue to try to charge and/or place holds with respect to all sums described above, or any portion thereof, to your credit card issuer until such amounts are paid in full.
You agree to provide Foxtraut Software Technologies Pvt. Ltd. with accurate and updated credit card information upon the request by Foxtraut Software Technologies Pvt. Ltd. including any point in time the information regarding the credit card you previously provided is no longer valid.
As the user, you acknowledge and agree that neither Foxtraut Software Technologies Pvt. Ltd. nor any Foxtraut Software Technologies Pvt. Ltd. affiliated company will suffer any liability, whatsoever for insufficiency of funds or other charges incurred by you as a result of such attempts to charge, and/or for placing holds on your credit card from the respective financial authorities.
If you have mistakenly provided a debit card number, instead of a credit card number, you authorize all charges described herein to be applied to said debit card, unless and until you provide a credit card number in replacement.
In the event of you getting enrolled, or enrolling later, in an automatic payment or electronic funds transfer system, you agree that all sums described herein may be charged, at Foxtraut Software Technologies Pvt. Ltd.’s discretion to the account number provided for said automatic payment or electronic funds transfer system for the services rendered.
For payment made by credit card or debit card, all clauses regarding payment will also be subject to the terms and conditions established by the credit or debit card issuer along with the policies of Foxtraut Software Technologies Pvt. Ltd. Company.
Renewal policy
The user agrees that Plan under the recurring payment plan will be automatically renewed for a period of half a year, unless otherwise given notice by the user ("auto renewal"). However, any Plan under the annual payment plan will not be automatically renewed and will expire at the end of the applicable term plan calculated annually.
The user’s credit card will be billed with the amount of the prevailing Plan charges as per the payment option that they select, at the time of registration with the Foxtraut Software Technologies Pvt. Ltd. company. If the user opts out of the auto renewal system, then he/she must inform us by placing a call at +1 302-319-2074 and communicate the same to our customer service representative, this should be done at least 30 days prior to the end date of the user’s Plan to intimate Foxtraut Software Technologies Pvt. Ltd. to discontinue the service.
Opting for Monthly payment services of Digital Marketing by user will have to give 30days advance notice, prior to the cancellation of any services of Digital Marketing.
By opting for any services of by the user(s), by default agrees to all the terms and conditions of the company.
